Terms of Service

These Terms of Service ("Terms") govern your access to and use of SS Optimizer ("the Service"). By creating an account, starting a subscription (including a free trial), or using the Service, you agree to be bound by these Terms.

1. Description of Service

SS Optimizer is a web-based calculator that helps financial professionals compare Social Security claiming strategies. The Service is provided strictly for educational and informational purposes and is not financial, tax, legal, or investment advice.

2. Eligibility

You represent that you are at least 18 years old and legally able to enter into a binding contract. The Service is intended for use by financial advisors and individuals researching Social Security claiming decisions. You are solely responsible for ensuring your use of the Service complies with applicable laws and professional regulations.

3. Subscription, Billing, and Trial

• The Service is offered on a paid monthly subscription basis at the price displayed on our pricing page ($20 USD per month as of the effective date).
• A 7-day free trial is offered. Payment method details are collected at signup via our payment processor (Stripe), but no charge is made during the trial period.
• If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be billed monthly until you cancel.
• You may cancel your subscription at any time via the billing portal. Cancellation stops future charges but does not retroactively refund past charges.

4. All Sales Final

All subscription fees are non-refundable. By subscribing, you acknowledge that you have been offered a 7-day free trial to evaluate the Service, and that charges made after the trial period are final. This applies even if you did not use the Service during a billed period.

5. No Financial Advice; Professional Responsibility

The Service provides estimates based on user-supplied inputs and simplified models. Results may differ materially from actual Social Security benefits paid by the Social Security Administration ("SSA"). The Service does not account for every factor that could affect benefits, including but not limited to the earnings test, taxation of benefits, Government Pension Offset (GPO), Windfall Elimination Provision (WEP), pending legislation, or changes in your client's earnings record.

You are solely responsible for the accuracy of inputs, the interpretation of outputs, and any advice or recommendations you provide to clients. Nothing generated by the Service constitutes a fiduciary recommendation or advice on your behalf.

6. No Affiliation with the SSA

SS Optimizer is an independent tool and is not affiliated with, endorsed by, or connected to the Social Security Administration, the United States government, or any government agency.

7. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SS OPTIMIZER, ITS OWNERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BENEFITS, LOSS OF DATA, OR DAMAGES RESULTING FROM DECISIONS MADE BASED ON OUTPUTS OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. User Responsibility and Compliance

You are responsible for:

• Safeguarding your account credentials and any one-time login codes sent to your email.
• Ensuring client information is handled in compliance with all applicable privacy, securities, and fiduciary rules.
• Including appropriate compliance disclosures on any reports you share with clients.

10. Data Privacy

Client scenario data entered into the calculator is processed in your browser and is not transmitted to or stored on our servers. The only personal data we retain is the email address associated with your subscription (stored via our payment processor, Stripe). For details, see our Privacy Policy.

11. Intellectual Property

All content, code, design, and branding of the Service are the property of SS Optimizer and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless SS Optimizer, its owners, operators, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your subscription will be canceled and you will lose access to the Service. Sections of these Terms that by their nature should survive termination (including Sections 4, 7, 8, and 12) will survive.

14. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or via the Service. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of such courts.

16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
